In a significant ruling for
Virginia
businesses, the Circuit Court for the City of Lynchburg
recently confirmed that a locality cannot tax gross receipts
attributed to a definite place of business in another
jurisdiction. Many local taxing officials have long contended
for a so-called "throwback" rule. They claim to have the
authority to tax all of a company's gross receipts unless
those receipts are taxed by another locality. This was a key
point the Virginia Chamber worked to address in the 1997 BPOL
