Advertising is everywhere in today’s digital world. Whether you pay for a single ad in the daily newspaper or run advertising campaigns on Google and Facebook, there are legal implications that surround what you say and how you say it.

Have you promoted a “free” offer or held a contest without looking into state and federal rules? Have you recently sent marketing newsletters to subscriber lists or requested basic contact information through your website? This is all advertising, and there numerous laws you could be breaking without even knowing it

Join Intellectual Property Attorney and former business and marketing consultant Ashley R. Dobbs, Bean, Kinney & Korman, for this workshop focused on the common advertising mistakes that can get you in trouble with the law. She will give insight on effective advertising without sacrificing legality.

The presentation will address Five Common Advertising Mistakes:

1. Not telling the truth: It is easier than you think to inadvertently create an advertising message that is deceptive, misleading, or omits necessary material. Think “free” offers, for starters. This is the FTC’s realm.

2. Not carefully comparing amongst competitors: There’s a way it can be done. Done the wrong way, you may be liable for trademark infringement or other legal claims.

3. Misusing contests and sweepstakes: There are laws in all 50 states and federal laws which govern sweepstakes and contests. Cross one, and you may have an illegal lottery or deceptive advertising claim on your hands.

4. Misusing children’s data or medical data: The Children’s Online Privacy Protection Act governs what you can collect and target and use in terms of children’s data, and HIPPA governs medical data. If you are operating in either field, or targeting children, you need to be complying with these laws.

5. Spamming: The CAN-SPAM act governs how business can and cannot conduct email advertising campaigns, and you may not be compliant. Statutory damages await those who violate the act.

Parking is available. Enter via the parking gate to the side of the hotel and collect a parking pass from the ticket dispensing machine. The parking pass allows 30 minutes of free parking in any available spot. An additional parking voucher will be available for you at our office for visits longer than 30 minutes. The voucher grants an additional 1 hour for a total of 1.5 hours of free parking.
